New York Bans “Gay Panic” Defence

New York approve ban on the use of “Gay panic” and “Transgender panic” defences in murder cases.

New York legislators have approved a ban on the use of the “Gay and Transgender Panic” defence as a justification for murdering upon finding out a victim’s sexuality or gender identity. Which made them suffer a temporary insanity. Passed yesterday, June 19, this ban will now be in action making impossible this type of justifications for gay or transgender murder cases.

Brad Hoylman, a state senator, and Democrat assemblyman Daniel J. O’Donnell, introduced the bill to ban the defence using the justification panic, last weekend.

“I’m glad that New York is sending a message to prosecutors, to defence attorneys, juries and judges that a victim’s LGBTQ identity can’t be weaponised.”

“I don’t think we can leave it to judges and juries given the record of homophobia that we’ve seen in courtrooms,” Said Brad Hoylman to New York Times. “We’re acting prudently to codify values of tolerance and acceptance of LGBTQ people.”

This outrageous defence has been used since the 1960’s, by lawyers and attorneys, even so this type of defence was not always effective.

This bill makes New York the sixth state to ban the “Gay Panic” and “Transgender panic” defences in recent years and it’s the fourth to come into action just this year.
